Amply LLC (referred to in this statement as “We”, “Us” and “Our”) provides employer matching services for eligible individual charitable donations (“Services”). We are committed to maintaining the privacy and security of the information that we receive from our Clients, Donors, Partners, and Visitors (each of whom is defined below). This Privacy Policy sets forth our practices with regard to the information we collect and process, which may include “Personally Identifiable Information” such as name, contact information, employer name, and other identifying information.

How We Receive Donor Information

Our “Clients” are 501(c)(3) charitable organizations that use our Services to process information received from individual donors who have consented to an employer match (“Donors”). Our “Partners” are companies that provide fundraising and donation management services, including the option of using Amply’s Services. Clients authorize us to initiate Services in two ways: (i) by registering directly with Amply or (ii) by enabling the Amply Extension on a Partner site. Initiation of Amply’s Services enables us to immediately receive Personally Identifiable Information of Donors who make online contributions to Clients.

What We Do with Donor Information

Consent. Clients using Amply’s Services must seek donor permission before Amply can contact a donor’s employer regarding a potential match. Donors must be informed, prior to making the donation, that Amply is a third-party data processer. Donors must also be presented with an opportunity to access Amply’s Terms of Service and this Privacy Policy. Collection. Amply limits its collection of Personally Identifiable Information to only what is needed to process employer gift matches on behalf of our Consenting Clients. A donor’s affirmative response to process an employer match, coupled with the donor’s employee email address and employer name, is considered consent for Amply to process information, including but not limited to, the following:
  • Donor’s name
  • Donor’s email address
  • Donor’s employer name
  • Date of Donor contribution
  • Dollar value of Donor’s contribution
  • Name of organization to whom the contribution is made
Sharing and Use. We may disclose Personally Identifiable Information to our employees, contractors, and agents who have a need to know such information in order to perform our Services. We share such information with relevant employers, Clients, and if applicable, with Partners. We do not sell or rent personal information to anyone, for any reason, at any time. We may also disclose such information in the event of a corporate change, or if required to do so by law, such as in response to a subpoena or warrant.

Retention.
Donor Data: 3 years from their last gift.
User Data: 18 months from their last login.
API Logs: 12 months.

Protection. We use a combination of firewall, antivirus, encryption and authentication measures, among others, to protect Personally Identifiable Information from unauthorized access and use. We also maintain and enforce a Security Policy and train our employees, contractors and agents on the importance of maintaining the confidentiality, privacy, and security of Personally Identifiable Information.

Opt-Out. A donor who does not consent to Amply receiving and using Personally Identifiable Information should refrain from using the Service. Such donors can also contact the recipient organization or Amply at info@Amply.org. Opting out of the Service may cause the recipient organization to lose the ability to obtain the employer match.

Use of Our Website and Web Services

“Visitors” are defined as anyone accessing and using the www.Amply.com site (“Website”), Facebook page, or emails (collectively referred to as “Web Services”).

Website. Amply uses Google Analytics to track Non-Personal Information such as Visitor utilization of our Website. Google Analytics collects information such as how often Visitors access the Website, what pages they visit, IP address, and what sites and keywords they used prior to coming to the Website. Google Analytics also uses "cookies", which are text files placed on a Visitor’s computer. Visitors can disable cookies in their browser settings. The Google Analytics Terms of Use https://www.google.com/analytics/terms/us.html and Google Privacy Policy https://www.google.com/policies/privacy/ govern Google’s ability to use and share Visitor information collected from our Website by Google Analytics. Amply does not collect Personally Identifiable Information of Visitors who access and use our Website.

Social Media. Amply uses third-party social media applications such as Facebook to interact with Clients, Partners, Donors and Visitors. Facebook’s Data Use Policy https://www.facebook.com/about/privacy governs its ability to use and share information collected from Visitors to our Facebook Page. Please note that by “liking” our Facebook Page, Visitors may automatically consent to sharing certain information with us, and the public, such as name, email address, and location. Amply may use this information in connection with our Services. Visitors are responsible for any information they make available on third-party social media applications.

Email. We may email prospective clients who have (i) enabled the Amply extension through a Partner site, (ii) contacted us through our Website or Facebook Page, or (iii) been referred to us. We may also email Donors and employers on behalf of our Clients. Our emails may contain web beacons to evaluate how emails were opened and whether they were acted upon. We do not sell or rent email addresses to anyone, for any reason, at any time.

Third Party Privacy Policies

This Privacy Policy addresses Amply’s use and disclosure of both Personally Identifiable Information and Non-Personal Information. Please note that we are not responsible for the practices or privacy policies of third-parties referenced in this Privacy Policy and we encourage you to learn about their privacy practices before providing any personally identifiable information. Such third-parties may include, for example, Clients, Partners, employers, and other third-parties with whom Clients, Partners, and employers engage. We are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with third-party use of your Personally Identifiable Information.

Children
We do not knowingly collect Personally Identifiable Information from children under 13. If we learn that we have collected such information, we will take steps to delete the information as soon as possible.

Conditions of Privacy Policy
By using our Website, Web Services, or Services, you signify your agreement to this Privacy Policy. If you do not agree to any of the terms and conditions of this Privacy Policy, you should not use our Website, Web Services, or Service. You agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of California. You further agree to the exclusive jurisdiction of the California courts.

Changes to Privacy Policy
This Privacy Policy may be changed periodically. Changes take effect immediately upon posting. Your continued use of our Website, Web Services, or Services following changes to the terms of this Privacy Policy will mean that you accept these changes. The date of last revision appears at the bottom of the Privacy Policy.
